Video recordings of the first training seminar (Brussels)

The first training seminar of the "Online training tool for European Judges on private enforcement of EU competition law”* project was taking place in Brussels, November 19-20, 2015.

The seminar was part of a series of two events that will form the basis of an online video training module in the field of private enforcement of completion law. The sessions will be filmed and the recordings will be later incorporated in the module. 

First day of the seminar

First session: Setting the scene – the principal EU level documents and the principles underlying the Directive: full compensation; effectiveness and equivalence; sincere co-operation - Adam Scott

 Second session: The claim: about what; who claims; against whom; where and when? - William McKehnie 

Second day of the seminar 

Adam SCOTT combined the information from previous presentations and brought practical issues in front of participating judges. His case study is about Notul Airport.

Diana UNGUREANU continued these interesting presentations and analyzed the issues arising from the Directive on Damages Actions and the role of the national judge. Full presentation here.

The speakers are reputed legal experts:

  • Adam SCOTT, founding member of the Competition Commission Appeal Tribunals, Director of Studies
  • Liam McKECHNIE, a Justice of the Supreme Court of Ireland
  • Judge Diana UNGUREANU, trainer for judges on commercial law and competition law, National Institute of Magistracy, judge at Court of Appeal Pitești, Romania.

Legislation

  • Directive 2014/104/EU of the European Parliament and of the Council of 26 November 2014 on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European Union
  • Council Regulation (EC) No 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 and 812 of the Treaty 

Participants

The seminar is dedicated to EU judges and prosecutors, as well as to apprentice national judges, and the staff of the judges’ offices or of national courts. Participants must be from EU Member States, with the exception of Denmark and the United Kingdom.

In focus

The seminar taking place in Brussels will be focused on the following issues:

  • Setting the scene – the principal EU level documents and the principles underlying the Directive: full compensation; effectiveness and equivalence; sincere co-operation
  • The claim: about what; who claims; against whom; where and when?
  • Managing a claim in court: what needs to be managed; Interactions with other bodies – the Commission, NCAs and other courts; jurisdiction and staying proceedings
